For a Total Disability Annuity, generally it doesn’t matter how many years ago you worked for the railroad, as long as you have 10 years of service, and you meet the criteria for disability within the required period. Also, if you have 5 to 9 years of railroad service, with at least 5 years after 1995, and you have subsequently worked at least 5 years under the Social Security system, you may qualify.
(There are many exceptions and legal requirements which need to be met, so every personal situation should be evaluated by a specialist; call us for a free consultation).
Occupational Disability Annuity requirements are much different, so please see our November, 2022 blog in that regard.
As you can see, the regulations are quite complex and require an attorney with extensive expertise. Call JB Bieske and Jennifer Alfonsi at 800-331-3530 for a free consultation to see if you may be eligible for Railroad (RRB) Disability benefits.
